Có thẻ xanh về Việt Nam quá hạn 1 năm.

Nếu thẻ xanh (I-551) của bạn còn hiệu lực, và bạn đã ở ngoài Mỹ ít hơn 1 năm, bạn có thể trở về Mỹ mà không có trở ngại gì.
Thẻ xanh của thường trú nhân hợp pháp tại Hoa kỳ (cả 2 loại thẻ xanh 2 năm và 10 năm), cho phép thường trú nhân này ra vào các cửa khẩu của Hoa kỳ một cách tự do, không giới hạn số lần, tuy nhiên luật di trú có một điều khoản khác buộc thường trú nhân phải có Giấy phép tái nhập cảnh / Re-entry permit (I-131) nếu thường trú nhân này cư trú ngoài Hoa kỳ trong khoảng thời gian trên 1 năm & dưới 2 năm. Bạn không thể xin Giấy phép tái nhập cảnh / Re-entry permit khi còn ở Việt nam.

Trong trường hợp hơn 2 năm, hoặc hơn 1 năm mà không có Reentry Permit xuất trình cùng với thẻ xanh, bạn có thể bị tước quyền thường trú tại Hoa kỳ, và bị từ chối không cho phép nhập cảnh.

Một khi bạn không còn hội đủ điều kiện để trở về Hoa kỳ như là một thường trú nhân hợp pháp, bạn phải nộp đơn tại ĐSQ/TSLQ xin cấp chiếu khán SB-1 (Special immigrant Returning Resident), chiếu khán di dân đặc biệt dành cho thường trú nhân trở về Hoa kỳ. Có một số tiêu chuẩn bắt buộc được áp dụng, trước khi bạn có thể có được chiếu khán SB-1.

Less Than a Year: Use Your Green Card

If you are a lawful permanent resident (immigrant) returning to the United States from a visit abroad of less than a year, you may apply for readmission by presenting your Permanent Resident Card ("Green Card") to the immigration authorities at a port of entry.

1-2 Years: Reentry Permit

If you are a lawful permanent resident or conditional permanent resident and wish to remain outside the United States for more than one year, but less than two, you require a reentry permit. A reentry permit is not required for a trip that is shorter than one year. (You should note that an absence of more than one year will break the period of continuous residence required to become a citizen, even if a reentry permit is issued -- see Application for Preservation of Residence). A Reentry Permit is also issued to lawful permanent residents who want to travel outside the United States, but cannot get a national passport from their country of nationality. A reentry permit is valid for two years and may not be extended.

Returning Resident (SB-1) Visa

If you are a lawful permanent resident and you are unable to return to the United States within the travel validity period of a Permanent Resident Card (one year), or a Reentry Permit (two years), you may apply to the nearest U.S. consular office for a special immigrant Returning Resident (SB-1) visa.
